Article 1 – Identification of the Seller
The Vintage Watch Spirit shop (hereinafter "the Seller") is a company specializing in the sale of vintage watches and collectible accessories.

Article 2 – Purpose and Scope
These General Terms and Conditions of Sale (T&Cs) govern all sales concluded between the Seller and any buyer (hereinafter "the Customer") placing an order on the Shopify website accessible at vintagewatchspirit.com
Any purchase made on the site implies unreserved acceptance of these T&Cs. These conditions apply to the exclusion of any other terms, unless otherwise agreed in writing by the Seller in advance.
Article 3 – Products
The Seller offers for sale second-hand and collectible vintage watches, as well as related accessories (straps, boxes, etc.). Each watch has a description sheet specifying:
- The overall condition and any defects noted
- Technical characteristics (brand, etc.)
- The price in euros, VAT included for customers in the European Union and excluding VAT for customers located outside the European Union, in accordance with Article 4 below
The photographs illustrating the products are contractual and faithfully represent the item offered for sale. The Seller undertakes to honestly describe the condition of each piece.
Vintage items are sold as is: their second-hand and vintage nature is an integral part of their value. Normal signs of wear inherent to age do not constitute a defect.
Where applicable, the presence of dust under the crystal, traces of oxidation, or residual moisture related to the age of the piece is mentioned on the product sheet and is part of the condition accepted by the Customer at the time of purchase.
Article 4 – Price
Delivery costs are indicated separately during the ordering process.
For customers residing in the European Union: the prices displayed include VAT applicable at the rate in force in the destination country at the time of the order.
For customers residing outside the European Union: prices are displayed excluding taxes. Customs duties, import taxes, and other local fees may be applied by the customs authorities of the destination country. These fees are entirely the responsibility of the Customer and are not collected by Vintage Watch Spirit. It is the Customer's responsibility to check with the relevant authorities in their country before placing an order.
Applicable VAT scheme: In accordance with Article 297 A of the French General Tax Code, transposing into French law the provisions of European Directive 2006/112/EC of 28 November 2006 on the common system of VAT (Articles 311 to 341, special scheme for second-hand goods), the vintage and second-hand watches offered for sale are subject to the special margin VAT scheme, applicable to second-hand goods sold by a taxable dealer. Under this scheme, VAT is calculated solely on the margin realized by the Seller, and not on the total sale price; it does not appear separately on the invoice, in accordance with applicable regulations. For customers in the European Union, the price displayed to the Customer remains tax-inclusive and its apparent calculation method does not change.
New accessories (straps, boxes, and other products not sold second-hand), on the other hand, are subject to the standard VAT scheme, calculated on the total sale price and shown separately on the invoice where applicable.
The Seller reserves the right to modify its prices at any time, without notice. Products will be invoiced based on the price in effect at the time the order is confirmed.
Article 5 – Order
Placing an order on the site proceeds as follows:
- Selecting products and adding them to the cart
- Reviewing and confirming the cart contents
- Entering delivery information
- Choosing the payment method and confirming payment
- Order confirmation sent by email
The sale is deemed concluded upon the Customer's receipt of the order confirmation email. The Seller reserves the right to cancel any order in the event of insufficient stock, a payment issue, or an abnormal order, with a full refund provided as soon as possible.
Article 6 – Payment
Payment is made online, at the time of ordering, via the secure payment methods offered by Shopify Payments:
- Bank card (Visa, Mastercard, American Express)
- PayPal
- Other methods depending on availability on the site
Transactions are secured using the SSL protocol. The Seller does not store any banking data. In the event of payment failure or fraud, the Seller reserves the right to suspend or cancel the order.
Article 7 – Delivery
7.1 Delivery zones
The Seller delivers worldwide (mainland France, French overseas territories, the European Union, and internationally).
7.2 Delivery times
Delivery times vary depending on the destination and the shipping method chosen (standard or express). They run from the shipping confirmation and are indicative. Please see our Shipping Policy page for details of delivery times by geographic zone.
7.3 Delivery fees
Standard delivery is free for France. Fees apply for express delivery within France as well as for any delivery to other regions of the world, according to the rates indicated during the ordering process.
7.4 Packaging
Given the delicate and precious nature of vintage watches, the Seller undertakes to package each item carefully, securely, and in a manner suitable for international transport.
Article 8 – Right of Withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of 14 calendar days from receipt of the package to notify their decision to withdraw, without having to provide any reason. They then have an additional period of 14 calendar days from this notification to physically return the item.
To exercise this right, the Customer must contact the Seller by email at contact@vintagewatchspirit.com before the expiry of the first period.

The right of withdrawal does not apply to goods made to the Customer's specifications or clearly personalized.
Article 9 – Warranties
9.1 Legal warranty of conformity
The Seller is bound by the legal warranty of conformity provided for in Articles L.217-3 et seq. of the French Consumer Code. In the event of a lack of conformity, the Customer may request repair or replacement of the item, or, if these solutions prove impossible or disproportionate, a refund.
As the watches offered for sale are, unless otherwise stated on the product sheet, sold second-hand, the time limit for bringing a claim under this warranty, as well as the presumption period for pre-existing defects, is set at twelve (12) months from delivery of the item.
9.2 Warranty against hidden defects
The Seller is liable for hidden defects, in accordance with Articles 1641 et seq. of the French Civil Code, when a defect renders the product unfit for its intended use, provided that defect was not apparent and the Customer could not have been aware of it at the time of purchase.
9.3 Specific nature of vintage items
Vintage and second-hand items are sold as is. Natural wear related to their age (patina, slight scratches, aging of gaskets) is inherent to their nature and does not constitute a defect. The conformity of the item is assessed in light of the description and photographs on the product sheet at the time of purchase, which faithfully reflect its condition.
9.4 Warranty of proper functioning
The Seller guarantees the proper functioning of each watch sold for a period of 12 months from the date of purchase. This commercial warranty is in addition to, and does not replace, the legal warranties of conformity and against hidden defects mentioned above, which the Customer benefits from in all cases.
This warranty does not cover malfunctions resulting from: exposure to water or moisture (vintage watches offering no guarantee of water resistance unless explicitly stated otherwise), dust ingress due to improper handling or storage after receipt, impact, dropping, servicing or intervention by an unauthorized third party, or the Customer's failure to properly maintain the product.
Article 10 – Liability
The Seller shall not be held liable for indirect or intangible damages resulting from the use of the purchased products, delivery delays attributable to the carrier, cases of force majeure (natural disasters, strikes, pandemics, government decisions, etc.), or the fraudulent use by a third party of the Customer's bank details.
Article 11 – Protection of Personal Data
The personal data collected when placing an order (name, address, email, phone number) is processed in accordance with the General Data Protection Regulation (GDPR – EU 2016/679) and the French Data Protection Act.
It is used solely for the purpose of processing and tracking orders. It is not resold to third parties without prior consent. The Customer has the right to access, rectify, delete, and object by contacting: contact@vintagewatchspirit.com.

Article 12 – Intellectual Property
All content on the site (texts, photographs, descriptions, logo, visual identity) is protected by intellectual property law and is the exclusive property of the Seller. Any reproduction, even partial, is prohibited without prior written authorization.
Article 13 – Disputes and Applicable Law
These T&Cs are governed by French law. In the event of a dispute, the Customer is invited to first contact the Seller to seek an amicable solution, at contact@vintagewatchspirit.com.
For cross-border disputes within the European Union, the Customer may contact the European Consumer Centre France (www.europe-consommateurs.eu).
Failing an amicable resolution, any dispute will be subject to the jurisdiction of the French courts.
Article 14 – Amendment of the Terms and Conditions
The Seller reserves the right to amend these T&Cs at any time. The applicable version is the one in effect on the day of the order. The new T&Cs will be published on the site with a new effective date.
