  • Email: contact@vintagewatchspirit.com

Article 2 – Purpose and scope

These General Terms and Conditions of Sale (GTCS) govern all sales concluded between the Seller and any buyer (hereinafter "the Customer") placing an order on the Shopify website available at vintagewatchspirit.com

Any purchase made on the website implies unreserved acceptance of these GTCS. These terms apply to the exclusion of all others, unless otherwise agreed in writing in advance by the Seller.

Article 3 – Products

The Seller offers for sale pre-owned vintage and collectible watches, as well as related accessories (straps, boxes, etc.). Each watch has a product page specifying:

  • Its general condition and any defects observed
  • Its technical specifications (brand, ...)
  • The price in euros, inclusive of VAT for customers in the European Union and exclusive of taxes for customers outside the European Union, in accordance with Article 4 below

The photographs illustrating the products are contractual and faithfully represent the item offered for sale. The Seller undertakes to describe the condition of each piece honestly.

Vintage items are sold as is: their pre-owned nature and age are an integral part of their value. Normal signs of wear inherent to age do not constitute a defect.

Where applicable, the presence of dust under the crystal, traces of oxidation or residual moisture related to the age of the piece is mentioned on the product page and forms part of the condition accepted by the Customer at the time of purchase.

Article 4 – Prices

Shipping costs are shown separately during the ordering process.

For customers residing in the European Union: displayed prices include VAT at the rate applicable in the country of destination at the time of order.

For customers residing outside the European Union: prices are displayed exclusive of taxes. Customs duties, import taxes and other local charges may be applied by the customs authorities of the country of destination. These charges are borne entirely by the Customer and are not collected by Vintage Watch Spirit. It is the Customer's responsibility to check with the relevant authorities in their country before placing an order.

Applicable VAT scheme: In accordance with Article 297 A of the French General Tax Code, which transposes into French law the provisions of Council Directive 2006/112/EC of 28 November 2006 on the common system of value added tax (Articles 311 to 341, special scheme for second-hand goods), the vintage and pre-owned watches offered for sale are subject to the special VAT margin scheme, applicable to second-hand goods sold by a taxable dealer. Under this scheme, VAT is calculated solely on the margin made by the Seller, not on the total sale price; it is not shown separately on the invoice, in accordance with applicable regulations. For customers in the European Union, the price displayed to the Customer remains inclusive of VAT and its apparent method of calculation does not change.

New accessories (straps, cases and other products not sold second-hand) are subject to the standard VAT scheme, calculated on the total sale price and shown separately on the invoice where applicable.

The Seller reserves the right to change its prices at any time without notice. Products will be invoiced at the price in force at the time the order is confirmed.

Article 5 – Orders

Ordering on the website proceeds as follows:

  • Selecting products and adding them to the cart
  • Reviewing and confirming the contents of the cart
  • Entering delivery information
  • Choosing a payment method and confirming payment
  • Order confirmation sent by email

The sale is deemed concluded upon receipt by the Customer of the order confirmation email. The Seller reserves the right to cancel any order in the event of insufficient stock, a payment problem or an abnormal order, with a full refund as soon as possible.

Article 6 – Payment

Payment is made online, at the time of ordering, via the secure payment methods offered by Shopify Payments:

  • Bank card (Visa, Mastercard, American Express)
  • PayPal
  • Other methods as available on the website

Transactions are secured by SSL protocol. The Seller does not store any banking data. In the event of non-payment or fraud, the Seller reserves the right to suspend or cancel the order.

Article 7 – Delivery

7.1 Delivery areas

The Seller delivers worldwide (mainland France, French overseas territories, the European Union and internationally).

7.2 Delivery times

Delivery times vary according to the destination and the shipping method chosen (standard or express). They run from the shipping confirmation and are indicative. See our Shipping Policy page for details of delivery times by geographical area.

7.3 Shipping costs

Standard delivery is free for France and the entire European Union. Charges apply for express delivery and for any delivery to other countries, according to the rates shown during the ordering process.

7.4 Packaging

Given the delicate and valuable nature of vintage watches, the Seller undertakes to package each item with care, securely and in a manner suitable for international transport.

Article 8 – Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has 14 calendar days from receipt of the parcel to notify their decision to withdraw, without having to give any reason. The Customer then has a further 14 calendar days from this notification to physically return the item.

To exercise this right, the Customer must contact the Seller by email at contact@vintagewatchspirit.com before the first period expires.

The practical arrangements for returns (shipping label, costs, insurance, refund conditions) are detailed in our Return Policy.

The right of withdrawal does not apply to goods made to the Customer's specifications or clearly personalised.

Article 9 – Warranties

9.1 Legal guarantee of conformity
The Seller is bound by the legal guarantee of conformity provided for in Articles L.217-3 et seq. of the French Consumer Code. In the event of a lack of conformity, the Customer may request repair or replacement of the item or, if these solutions prove impossible or disproportionate, a refund.

As the watches offered for sale are, unless otherwise stated on the product page, second-hand goods, the period for bringing a claim under this guarantee and the period during which the defect is presumed to have existed at delivery are set at twelve (12) months from delivery of the item.

9.2 Warranty against hidden defects
The Seller is liable for hidden defects, in accordance with Articles 1641 et seq. of the French Civil Code, where a defect renders the product unfit for its intended use, the defect was not apparent and the Customer could not have been aware of it at the time of purchase.

9.3 Specific nature of vintage items
Vintage and pre-owned items are sold as is. Natural wear related to their age (patina, light scratches, ageing of gaskets) is inherent to their nature and does not constitute a defect. The conformity of the item is assessed against the description and photographs on the product page at the time of purchase, which faithfully reflect its condition.

9.4 Working order warranty
The Seller guarantees that each watch sold will function properly for a period of 12 months from the date of purchase. This commercial warranty is in addition to, and does not replace, the legal guarantees of conformity and against hidden defects mentioned above, which the Customer enjoys in all cases.

This warranty does not cover malfunctions resulting from: exposure to water or moisture (vintage watches offer no guarantee of water resistance unless explicitly stated otherwise), dust ingress due to improper handling or storage after receipt, impact, dropping, servicing or work carried out by an unauthorised third party, or failure by the Customer to maintain the product.

Article 10 – Liability

The Seller cannot be held liable for indirect or intangible damages resulting from the use of the products purchased, delivery delays attributable to the carrier, cases of force majeure (natural disasters, strikes, pandemics, government decisions, etc.) or fraudulent use of the Customer's bank details by a third party.

Article 11 – Personal data protection

Personal data collected when ordering (name, address, email, telephone) is processed in accordance with the General Data Protection Regulation (GDPR – EU 2016/679) and the French Data Protection Act (loi Informatique et Libertés).

It is used solely for the purpose of processing and tracking orders. It is not sold to third parties without prior consent. The Customer has the right to access, rectify, delete and object to the processing of their data by contacting: contact@vintagewatchspirit.com.
To find out more, see our Privacy Policy.

Article 12 – Intellectual property

All website content (texts, photographs, descriptions, logo, visual identity) is protected by intellectual property law and is the exclusive property of the Seller. Any reproduction, even partial, is prohibited without prior written authorisation.

Article 13 – Disputes and governing law

These GTCS are governed by French law. In the event of a dispute, the Customer is invited to contact the Seller first in order to seek an amicable solution, at contact@vintagewatchspirit.com.

For cross-border disputes within the European Union, the Customer may contact the European Consumer Centre France (www.europe-consommateurs.eu).

Failing an amicable resolution, any dispute shall be submitted to the jurisdiction of the French courts.

Article 14 – Amendments to the GTCS

The Seller reserves the right to amend these GTCS at any time. The applicable version is the one in force on the date of the order. New GTCS will be published on the website with a new effective date.
